Terms & Conditions of Use | Privacy Policy
1. Acceptance and scope
These Terms and Conditions of Use (“Terms”) govern your access to and use of stokes.com and related online services (the “Website”), operated by Restaurants, Inc. (“Restaurants,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms and applicable law. If you do not agree, do not use the Website.
2. Website content and permitted use
The Website’s text, photographs, menus, logos, graphics, software, and other materials are owned by Restaurants, Inc. or its licensors and protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive license to view the Website and temporarily download one copy of its materials for your personal, noncommercial use. You may not:
Copy, modify, distribute, or commercially use Website materials;
Display Website materials publicly without permission;
Decompile or reverse engineer Website software, except where applicable law does not permit this restriction;
Remove copyright or proprietary notices; or
Transfer, mirror, or republish Website materials on another server.
This license ends automatically if you violate these restrictions. When it ends, you must delete or destroy copies in your possession.
3. Online orders and reservations
Orders, reservations, and other requests are subject to availability and our acceptance. A confirmation that we received your request does not necessarily mean that we accepted it. We may reject or cancel an order or reservation because of unavailability, a pricing or menu error, suspected fraud, delivery-area limits, or other reasonable operational reasons. If we cancel a paid order, we will arrange a refund to the original payment method or provide another remedy where required by law.
Prices, taxes, service charges, delivery fees, and other amounts will be shown or calculated at checkout where applicable. Review your order before submitting it.
Pickup and delivery estimates are not guarantees. Delivery may be handled by Restaurants, Inc. or a third-party service, and that service’s terms may also apply. You are responsible for providing accurate contact and delivery details and being available to receive your order.
Because food is perishable and preparation may begin promptly, an order may not be changed or cancelled once preparation has started. Contact us immediately to request a change. For an incorrect, missing, or damaged order, contact us within five minutes of order placement so we can review the issue and, where appropriate, offer a replacement, refund, or other remedy.
4. Menu information and food allergies
Menu descriptions, ingredients, and dietary information are provided as a convenience and may not identify every ingredient or possible cross-contact risk. Ingredients, suppliers, recipes, and preparation methods can change. If you have an allergy or dietary restriction, contact us before ordering and confirm the information with restaurant staff. We cannot guarantee that an item is free from a particular allergen or cross-contact.
5. Website information, disclaimer, and availability
We try to keep Website information current, including menus, prices, ingredients, hours, and promotions, but errors may occur. Information may change without notice. The Website and its materials are provided “as is” and “as available.” To the extent permitted by law, Restaurants, Inc. disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that Website materials are accurate, complete, current, or uninterrupted. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
6. Acceptable use
You may use the Website only for lawful purposes. You may not interfere with Website operation, attempt unauthorized access, provide false or misleading information, introduce malicious code, or use automated means to extract Website content without our written permission.
7. Third-party links and services
The Website may link to or use third-party services, including payment, ordering, reservation, mapping, analytics, or delivery services. Restaurants, Inc. does not control and is not responsible for third-party websites or services. A link does not imply endorsement. Third-party terms and privacy policies apply to your use of those services.
8. Limitation of liability
To the extent permitted by law, Restaurants, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business interruption, arising from your use of or inability to use the Website—even if we were advised that such damages were possible.
9. Revisions
We may update the Website or these Terms. Revised Terms will be posted here. Continued use of the Website after revised Terms are posted means you accept them, to the extent permitted by law.
